e) A docum ent of agreem ent of all co-owners if the copyrights, related rights belong to joint ovvnership.

1. The S tate m anagem ent au th o rity in charge of copyrights an d related rights shall have the com petent authorities to issue the Copyright R egistration C ertiĩicates, and

Related Rights Registration Certificates.

2. The S tate m anagem ent authority in charge of copyr i g h t s a n d related r i g h t s w h i c h h a v e t h e p o w e r t o i s s u e

Copyright Registration Certificates. an d R elated Rights

Registration Certificates, shall also have th e power to reissue, replace or annul such certificate.

3. The Governm ent shall m ake specific provisions for

conditions, orders and procedures for issuing, replacing

and annu lm en t of Copyright R egistration Certificates, and

Related Rights Registration Certiĩicates.

4. The M inistry of C ulture and Iníorm ation shall set

out forms of Certificate of R egistration for copyrights and

related rights.

1. C o pyrig ht R egistration C ertificates or Related

Rights R egistration Certificates shall be eíTective in the

whole territory of Vietnam.

2. C opyright R eg istration C e rtiĩic a te s or R elated

Rights R egístration Certiíicates issued by the S tate managem ent autho rity in charge of copyrights and related

rights before th is Law comes into fuU force shall have its

valiđity m aintained.

2. Decision to issue, re-issue. change or to an n u l the

validity of Copyright Registration Certificates or Related

R ights R egistration Certiĩicates m ust be published in the

Official G azette in respect of Copyrights, Related rights.

1. When a Copyright R e ^ s tra tio n Certificate, Related

Rights Registration C ertiữcate is lost, or dam ageđ or if the

Copyright owner or related rig h t o w n e r is c h a n g e d , the

authoritv referred to in Article 51.2 of this Law shall reissue or replace such Copyright Registration Ccrtificate,

Related Rights Registration Certificate.

2. When an índividual, who is granteđ registration certificate of copyrights, related rights, is not th e author, the

C o p y r i g h t or r e l a t e d r i g h t ow ner or w o r k , p e r f o r m a n c e s ,

phonogram, broadcasting program regislered il not a protected subject m atter, th e auth ority reíerred to in Article

51.2 of this Law shall an n u l th e validity of such Copyright

R egistration C ertiĩicate, R elated R ights R eg istration

Certificate.

3. Any organization or indiviđual who discovers th a t

th e g ra n t of a C opyright R egistration C ertificate or

Related Rights Registration Certiĩicate is contrary to the

provisions of th is Law shall have the right to request the

S ta te m a n a g e m e n t a u th o r ity in c h a rg e o f c o p y rig h ts , relat-



ed rights to cancel th e validity of such certificate.

on th e basis of agreem ent am ong authors, copyrights owners, related rights owners, operates in accorđance with the

2. Collective m anagem ent organizations of copvrights

and related rights shall carry out the following activities as

authorized by authors, copyrights. related rìghts ovvners:

a) To m anage copyrights and related rights; to negotiate on licensing, seizing an d dividing royalties, rem uneration an d other m aterial beneĩits th ere from the allowance

of exploiting the authorízed rights:

b) To protect m e m b ers rights and legal beneĩits, to

m ediate any dispute,

d) O ther rights and duties according to th e provisions

of th e law.

2. Consultancy an d S e r v i c e organizations of copyrights

as requested by authors, copyrights owners, related right

owners:

a) To do consultancy work of issues reỉatin g to the law

on copyrights an d related rights;

b) To carry ou t application procedures for registration

of copyrights, related rights under th e au thorization on

b eh alf of copyrights owners, relateđ rig h t owners;

d o i n g b u s in e s s ; C o m p u t e r p r o g r a m s ;



3. Presentations of ìnformation;

4. Solutions of aesthetic characteristics only;

5. P lan t varieties, anim al varieties;

6. Processes of essentially biolopcal n a tu re for the production of plants and anim als other th a n microbiological

processes;

7. Disease prevention, điagnostic and tr e a tm e n t methods for h u m an or animais.

A r tic le 60. Novelty o f ỉnventions

1. An invention shall be considered as novel íf it is not

publicly discloseđ by use or m eans of a vvritten or oral

description or any other form, inside or outsiđe the country, before the ĩiling date or the priority date, as applicable, of th e invention registration application.

2. An invention shall be considered as not yet publicly

disclosed if it is known to only a lim ited num ber of persons

who are obliged to keep it secret.

3. An invention shall not be considered as lacking of

novelty if it was published in the following circum stances,

provided th a t the invention registration application is Tiled

w ithin 6 m onths from the date of publication:

a) It w as published by an other person w ithout permission of th e person having th e ríg h t to registration as provided for in Article 86 of this Law;

b) It w as pubiished in th e form of a scientific presentation by th e person having the rig h t to registration as provided for in Article 86 of th is Law;

c) It w as exhibited a t a national exhibition of V ietnam

o r at a n o f f ic i a l o r o f f ic i a l ly r e c o g n iz e d I n t e r n a t io n a l e x h ibition by th e person having the right to registration as provided for in Article 86 of this Law.

A rticle 61. Inventive step o f inventỉons

An invention shall be considered to involve an inventive step, based on all technical solutions alreađy disclosed

by use or m eans of a w ritten or oral description or any

other form inside or outside the country, prior to th e filing

date or the priority date, as applicable, of the invention

reg istra tio n application, it c o n s titu te s a n inventive

progress an d cannot be easily createđ by a person with

ordinary skill in th e art.

An invention shall be considered as susceptible of

in dustrial application if it is possible to carry o u t massive

1. An in dustrial design shall be considered as new if it

significantly differs from other in d u stria l designs th a t are

aỉready discỉosed by way of use o r description in w riting or

in an y o ther forms inside or outsiđe th e country prior to

the filing date or the priority date, as applicable, of the

industrial design registration application.

2. Two industrial designs shall not be consiđered as

signiíícantly different from each oth er if they are only dif359
