K ey is s u e s in the Law on Intellectual Property

a) T aking technological m easures to prevent inừingem ent of intellectual property rights;

b) R equesting organizations, indiviđuals t h a t have

comm itted acts of iníringem ent of intellectual propẹrty

rights to te rm in ate th e infringing acts, apologize, publicly

rectify and com pensate damages;

c) Requesting th e com petent State agencies to handle

acts of iníringem ent of intellectual property rig h ts in

accordance with provisions of th is Law a n d other related

law s and regulations;

d) Initiatin g a law su it a t a com petent court or a n arbitra to r to protect th e ir legitim ate ríg h ts and interests;

m eans th e competent organizations or individuals use

The court shall take the foIlowing civil rem edies to

h an d le organizations and individuals th a t have com m itted

a c ts of infringem ent of intellectual property rights;

1. Compelling term in atio n of th e iníringem ent of intellectual property rights;

2. Compelling public rectification and apologv:

3. Compelling the perform ance of civil obligations;

4. Compelling com pensation for damages;

5. Compelling destruction, distribution or use for noncom m ercial purpose in respect of goods, m aterials and

im plem ents the predo m inan t use of which h a s been in the

creation or tra d in g of intellectual property rig h t infringing

goods, provided th a t such distribution a n d u se does not

affect th e exploitation of rights by the intellectu al property rig h ts holder.

1. The plaintiff a n d defendant in a lavvsuit ag ain st

infring em ent of intellectual property rig h ts sh a ll h av e th e

rig h ts and b u rd e n of proof provided for in A rticle 79 of th e

Civil Procedures Code and th is Article.

2. T h e p l a i n t i f f s h a l l p r o v e t h a t h e o r s h e i s t h e i n t e l -



lectual property rig h t holder with one of th e foUowing evidences:

a) A valid copy of the Copyright R egistration Certiíìcate,

R elated R ight R egistration CertiTicate, Protection Title, or

a n ex tract from the N ational Registers of C opyrights a n d

R elated R ights, th e N atio n a l R eg isters of In d u s tria l

D esig ns, la y o u t-d esig n s a n d N a tio n a l R e g is te rs of

Protected P la n t Varieties;

b) N ecessary evidence proving basis th e e sta b lish m e n t

o f copyrights, related rig h ts in case of absence o f a Copy­

rig h t reg istratio n certificate, related rig h t re g istra tio n certificate; necessary evidence proving th e rig h ts to business

secrets, tra d e nam es or well-known m arks;

c)

Copies of licensing contracts for u sin g intellectual

property subject m a tte rs in case the rig h t to use is licensed

u n d e r a contract.

3. The plaintiff shall produce evidence of the infringe'

m e n t of intellectual property rig h ts or acts of unfair competition.

4. In a law suit a g a in st a n in ử in g e m en t of the rig h t to

a p a te n te d invention, which is a production process, the

d e f e n d a n t s h a l l p r o v e t h a t h i s or h e r P r o d u c t s a r e m ade b y

a process other th a n th e protected process:

a) The product m ade by th e protected process is new;

b) The product m ade by the protected process is not

new, b u t the owner of the protected process believes th a t

th e product of the d eíen d a n t Ì8 m ade by the protected

process and failed identify th e process used by the defend a n t despite th a t reasonable m easures have been taken.

5. In case a p a rty to a law suit a g a in st a n infringem ent

of inlellectual property rig h ts has proven th a t evidence

relev an t to su b stan tiatio n of his or h e r claim s lies in the

control of the o th er p a rty a n d therefore inaccessible, the

íorm er shall have th e rig h t to req u est th e court to compel

th e la te r to produce such evidence.

have not yet been included in th e total phvsical damage;

b) T h e value of th e tr a n s f e r of th e rig h t to use th e intellectual p ro perty subject m a tte r w ith th e p resu m p tio n th a t

th e d e fe n d a n t has been tra n s fe rre d by th e p la in tiff with

the rig h t to use th a t in telle c tu al prop ertv subject m a tte r

u n d e r an a g re e m en t for u sin g such in te lle c tu a l property

subject m a tte r to th e e x te n t eq u iv alen t to th e act of

in ừ in g e m e n t com m itted;

c) \V here it is im possible to d e term in e th e r a te of compen satio n in accordance w ith su b p a ra g ra p h s a) a n d b) of

this p a ra g ra p h , t h a t r a te sh all be fixed bv th e co u rt depending on th e loss level b u t not exceeding VND 500 million.

In addition to th e dam ages referred to in clauses 1

and 2 of th is Article, a n IP R holder m ay req u est th e court

to compel th e iníring er to pay reasonable costs of h irin g

attorneys.

 r ti c le 206. R ỉ g h t to request t h e c o u r t to a p p ly



p ro v ỉsio n a l m easures

1. Upon or after in itiatio n of a law suit, a n intellectual

property rig h t holđer shall have th e right to req u est the

court to apply provisional m easu res in th e following cases:

a) There is a th r e a t of irrep arab le dam age to the intellectual property righ t holder;

b) T here is a th r e a t of dispersal or destruction of goods

suspected of infringing upon intellectual property rig h ts

a n d relev an t evidence if th ey are not protected in time.

2. The court shall decide to apply provisional m easures

a t th e re q u e st of the IP R holder as set out in clause 1 of

this Article before listen in g to th e opinion of the p a rty

liable for such provisional m easure.

A r t i c l e 207. P ro visio n a l m easures

1.

T he following provisional m easu res are shall applicable to goods suspected of in ữ in g in g upon intellectual

property rig h ts or to th e m ateriaU , raw m aterials or imple-

m e n ts for producing or tra d in g such goods:

a) Seizure;

b) A ttachm ent;

c) Sealing, prohibition of changing s t a t u s or displacing;

d) Prohibition of tra n sfe rrin g ownership;

O ther provisional m easu res shall be applied in

accordance w ith the Civil Procedure Code.



A rtỉc ỉe 208. O b l i g a t i o n s o f t h e p e r s o n w ho

requeats fo r the a p p lica tio n o f p ro v ỉsio n a l m easurea

1. A person who req uests for the application of provisional m e a s u r e s i s o b l i g e d t o p r o v e h i s o r h e r r i g h t t o

re q u e st as provided for in p a ra g ra p h 2 Article 206 of th is

Law, incỉuding th e production of m aterials a n d evidence a s

provided for in p a ra g ra p h 2 Article 203 of th is Law.

2. A person who req u ests for th e application of provisional m easures is obliged to pay com pensation for the

d am ag es to such provisional m easu re debtor in case such

p erson is found not to infringe th e IPRs. To secure the perform ance of this obligation, th e person who req uests for

th e appỉication of provisional m easu res m u st deposit a

sum of security in one of th e following forms:

a) Depositing a n a m o u n t of money equâl to 20% of th e

value of the goods th a t is subject to the application of provisional m easures. or a t least 20 million VND if it ís impossible to ev alu ate those goods;

b)

Subm itting a g u a ra n tee docum ent issued by a ban k

or other cređit organizations

A r tic le 209. T erm in a tỉo n o f the a p p iic a tio n o f



p ro visỉo n a l m easures

1. The court shall deciđe to term in ate the application of

a provisional m easure in any of the cases rerred to in

p arag ra p h 1 Articìe 122 of the Civil Procedure Cođe or in

case th a t the provisiona! m easure debtor succeeds in proving th a t the application of such provisional m easure is

unreasonable.

2. In case of term ination of the application of a provisional m easure, the court shall consider reim bursem ent to

the requesting person of the deposited am ount reíerređ to

in paragraph 2 Article 208 of this Law. If the request for th e

appỉication of provisional m easure is unreasonable, causing

dam age to th e provisional m easure debtor, the court shall

compel the requesting person to com pensate the damage.
